Welcome to PeopleForBikes! This website (including any subpages or mobile versions thereof, the “Site”) is owned, operated and maintained by the PeopleForBikes Coalition, a 501(c)(6) non-profit, and the PeopleForBikes Foundation, a 501(c)(3) non-profit (collectively “PeopleForBikes,” “us,” “our,” or “we”). At PeopleForBikes, we recognize that visitors to the Site may be concerned about the information they provide and how we treat that information. This Privacy Policy (the “Policy”) addresses those concerns.

This Policy forms an agreement between you and PeopleForBikes. We may update the Privacy Policy from time to time, so please check in occasionally. By continuing to browse the Site or by providing us with your Personal Information, you consent to the current terms of this Policy.  

Additional Agreements & Third-Parties

This Policy is incorporated into our Terms of Use and may include terms that are defined in that agreement. Third parties, however, are not bound by this Policy and may have privacy policies with different terms regarding the disclosure and use of your Personal Information. Please review the policies of third parties before you provide Personal Information to them.

Information We Collect and How We Use It

We may collect certain Personal and non-Personal Information from you through the Site. For purposes of this Policy, “Personal Information” means any information that can be used to identify you as an individual, including your full name; address; online contact information, such as an email address, screen name or username; or any persistent identifier that can be used to recognize you over time and across different services; and any information about an individual linked to such identifying information.

You can visit this Site without providing Personal Information. We typically collect information from you in the following ways:

When you join – When you sign up on the Site, we collect your name, email address, and zip code. If you choose, we will collect the name, city and state of any one who refers you. We generally use registration information so that we can contact you about your account, to contact you and keep you up to date on our foundation and activities, and as otherwise necessary to administer our Site. When you join or register on our Site, you consent to our contacting you about our organization, for fundraising purposes, to take action on legislative issues and regarding upcoming events.

If you register on our site as a retailer, supplier, team, or business, we collect additional information about your business, such as your business address and contact information, and other related information. This information is used to provide local cyclists and interested parties with a list of resources in their area and is made public on our Site.

When you make a purchase – Purchases on our Site may be handled directly by PeopleForBikes or processed by third party service providers.  We or those third party service providers typically collect your name, email address, phone number, mailing address, payment account information, security codes, and other Personal Information that may be required to process your transaction.

We or our third party service providers use purchase information in order to administer, manage and correspond with you about your purchase, and we reserve the right to add your Personal Information to our mailing list so that we may provide you with updates about our foundation and activities, or provide other information that may be of interest to you.

When you share a story – When you share a story, we request your name, email address, state, city and zip code of residence, and the title and content of your story. We will, therefore, collect any additional Personal Information you provide in your story. We may post the story, its title, your name, city and state on our Site where it will be publically available. We will use the information you provide using the story sharing form only as part of this feature of our Site.

When you take action –  When you take action using our Site’s take action page and form, we request your name, street address, city, state zip and/or zip+4 digits. We use this information to determine the names and contact of government representatives and other entities or organizations in your area that you can contact with your views. Any Personal Information you provide through the take action form itself may be shared with the person or entity you choose to contact. Do not provide any Personal Information or other information that you do not wish to share with that person or entity.

When you donate – When you donate on our Site, we collect your credit card number, expiration date, your name, address, and other Personal Information necessary to process this transaction. We may share that information with a third party for payment processing, or you may provide that information directly to that party when you make you payment. In either case, payment information provided when you make a donation will be used to process your transaction, and we reserve the right to use your Personal information to add you to our mailing list or contact you about your purchase.

If you click on one of the links to donate to PeopleForBikes on our Site using PayPal, you will be directed to PayPal’s site, at which you may enter your payment information and other details.  Please note that you are providing this information directly to PayPal and not to us, and that we do not see or receive any of your credit card information (although non-financial Personal Information about you and your donation may be sent to us and used in accordance with this section.)

When you contact us about the Site – If you choose to contact us using the “contact us” form on our Site, we collect your email address and zip code, and if you choose, your name. We use this information only to contact you and respond to your request or inquiry.

When you use the Local Engagement Portal – If you choose to contact us using our Local Engagement Portal page on our Site, we collect your email address and certain information about the organization you represent, the actions you wish to take or issue you wish to publicize, and other related information you choose to provide through our web form. We may share any information you provide through the Local Engagement Portal with our network of members and other individuals who may be interested in your issue. Please do not submit information to the Local Engagement Portal that you do not wish to be made available to the public.

From cookies and web analytics We use cookies and related technologies on the Site. Cookies are information stored on your computer by your browser to save your preferences while you are visiting a particular site. When you log in, the cookie tells us whether you've visited us before or are a new visitor. These cookies do not collect any Personal Information about you or provide us with any way to contact you, and the cookie doesn't extract any information from your computer. We may use the cookie for security, to learn about and improve upon how users navigate a website or to enable certain features.

We may also use pixels, or transparent GIF files, and similar technologies to help manage online analytics. These technologies enable us to recognize a unique cookie on your Web browser, which allow us to learn about how users navigate within a page, between pages, and to generally improve the content, navigation, and user experience on our Site.  With both cookies and pixels, the information that we collect and share is anonymous and not personally identifiable. If you do not enable cookies to be received by your web browser, you may not be able to access certain features and functionality on this Site.

Please note, most modern browsers include a “do not track” feature that may help protect your privacy. However, because there is not yet a defined response to do-not-track requests, our Site does not respond to your browser’s do-not-track request.  In addition, we do not, nor do we allow third parties to, track our Site visitors over time or across third party sites.

Our Site may use cookies provided by website analytics services such as Google Analytics to help us better understand how our Site is used. How we disclose or share information

We value the privacy of your Personal Information. Except as described below, we do not typically share your Personal Information with unrelated third parties. You consent to sharing the Personal Information you provide us when you choose to take action by reaching out or donating to local individuals or organizations. We share only non-financial Personal Information with a party to whom you donate for fundraising purposes. If you share a story, make a post on our Site, or share through social media, any Personal Information you provided through that feature will be shared with the public. Do not provide any information using these features that you do not wish to share in accordance with this paragraph.

We may, without your consent, share Personal Information with service providers who provide services on our behalf and provide protections that are consistent with this Policy. For example, we may share certain Personal Information with third parties such as providers of data hosting or processing services and other providers of essential and internal services.

In limited circumstances, we may share Personal Information we possess as part of a sale or transfer of our business, or substantially all of our assets. We may also share Personal Information if we need to protect the interests of PeopleForBikes, our customers, property, or the public, to the extent allowed by law. Similarly, we may share Personal Information with governmental authorities or otherwise in response to a legal request that we believe requires us to do so. We will share any such information to the extent we believe that request requires. Legal requests include, for example, search warrants, subpoenas, and other orders issued by courts, regulators and other governing bodies. We may also receive legal requests or orders from jurisdictions outside the United States, in which case you consent for your Personal Information to be transferred to the applicable country.

Security measures

PeopleForBikes takes reasonable precautions to protect your Personal Information. Payment information, such as your credit card number and related information, is collected on a secure web page to protect the confidentiality of the data. No transmission of data over the internet or other public network can be guaranteed to be 100 percent secure. We make reasonable efforts to secure your Personal Information once we receive it, but we cannot guarantee the security of information you send to us.

Your rights to access and update your information

We will respond to reasonable requests for access or revision and will provide access to the extent required or allowed by law. However we may decide not to grant access or make revisions where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in any given case, or when the rights of others would be violated by granting the access.

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information by PeopleForBikes to others for direct marketing purposes during the preceding calendar year. With respect to these other parties, this Privacy Policy applies only to their activities within the State of California. To make such a request, please send a written, signed request to us using the address provided below.

Your choices with regard to your information

It is possible for you to use our Site without providing any Personal Information. You may opt out of additional communications from us. Please note, if you do not wish for us to provide certain information to one or more of our service providers, we may be unable to complete a transaction you request. You can unsubscribe from all email newsletters or similar communications by clicking on the unsubscribe link in every email. You may opt out of all other information sharing by contacting us at the address or email below.

Rights of minors

PeopleForBikes is committed to protecting the online privacy of children and making the internet safe. This Policy reflects applicable laws and regulations on children's privacy. All persons under 18 years of age are expected to have permission from their parents before using the Site. This Site is not intended to nor do we knowingly collect Personal Information from children under 13 years of age.

In the event a minor submits Personal Information on our Site, parents may review, edit, request the deletion, or prevent further collection or use of their minor children's Personal Information.  Parents may also choose to agree to the collection and use of their child’s information, but not allow disclosure of such information to third parties unless it is inherently part of the Site.  Parents may request any of these actions, or make inquiries regarding our privacy practices, by sending an email or letter to us at the address below.

To the extent required by California Law, we permit minors under the age of 18 to request the deletion of any content or information that the minor has posted or made publicly available through our Site. To request that information you have made available on our Site be removed, please send a letter or email to the address below with (i) your name, (ii) a complete description of the content you would like removed, and (iii) the web address(es) of the content you would like removed. Please be aware that our fulfillment of this request does not ensure complete or comprehensive removal of the content or information you have posted on our Site.

International guests

If you are accessing this Site from outside of the United States, you consent to the transfer of your Personal Information to the United States, and the processing, use, and sharing of your Personal Information in accordance with this Policy. Regardless of where your Personal Information is collected or transferred, the information will be treated in accordance with this Policy.

Limitation of liability

By providing us with any Personal Information, you expressly and unconditionally release and hold harmless PeopleForBikes, its parents, subsidiaries, affiliates, related companies and their respective shareholders, owners, members, directors, officers, employees and agents (collectively, the “Releasees”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected Personal Information. In addition, while we take reasonable steps to prevent third-party companies from making unauthorized use of your Personal Information, we cannot be held liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your Personal Information collected by those third parties.

Changes to our Privacy Policy

By using our Site or providing Personal Information to us, you consent to the terms of this Policy. We may change this Policy from time to time. We will post the effective date for this and any revised policy. Accordingly, we recommend that you consult this page frequently so that you are aware of our latest Policy. Your continued use of our Site constitutes your acceptance of any revised Policy.
